Slob, when I said it could be considered a copyright or trademark infringement - or not - depends upon if it goes to court, if a judge decides whether or not it has judicial merit, and, if it does indeed go to trial, which way the wind blows with the judge or jury.

These things can be open to interpretation. IMHO, avoiding legal trouble is preferable to courting it.

Which reminds me of what one of my friend's bands did a few years ago. The title of their "big" song (one that actually got played on the radio) was the name of a large chain of stores, and the subject matter was shopping at said stores. The lawyers sent the standard cease-and-desist letter, to which the band replied that the chain and their lawyers should "go f**k their mothers." A ballsy move (and a hilarious one), yes, but one they regretted later.

From a 1995 document called Intellectual Property and the National Information Infrastructure, published by the US Patent and Trademark Office:

A copyright owner has the exclusive right to:
  • Reproduce the copyrighted work;
  • Prepare derivative works based on the original copyrighted work;
  • Distribute copies of the copyrighted work to the public by sale or other transfer of ownership, to prevent others from doing so, and to license others to do so;
  • Display the copyrighted work publicly.

there's some more. I say WHO CARES, it's not for profit and it's not like we're going in direct competition with them. I do remember the rip-off craze of the early 90's (remember Counterfit, anyone?) My buddy rode for them and basically the law states if the imposter varies over 70% of the original piece in question then you are going to be up shit creek.

As long as what's done is done and there is no intention of making a whole shitload of shirts for sale to the general public (as opposed to everyone who requested one), I'd just suggest rolling over and saying that you won't do it anymore if and when Indy pitches a fit (which I kind of doubt that they will, but stranger things have happened...).

Don't lose sleep over it.
